Terms of Service

Welcome to Daigosoft. These Terms of Service ("Terms") cover your use of our software applications, including Daigo Notebook, Daigo Writer, and Daigo Projects, as well as any associated optional data synchronization subscriptions (collectively, the "Services"). By using the Services, you agree to these Terms.
1. The Services
We provide a suite of software applications designed to manage and organize your notes and projects and author texts. We also offer a optional paid subscriptions that allow you to securely sync your data across multiple devices for supported applications.
2. Your Account
To use the sync subscription, you need to create an account. You are responsible for keeping your account credentials secure. Let us know immediately at security@daigosoft.com if you suspect any unauthorized use of your account.
3. Payments, Subscriptions, and Cancellation
Our order process is conducted by our online reseller and Merchant of Record, Hotmart. They act as the official reseller of our Services and handle all payment processing, invoicing, and VAT collection securely under their own terms.
- Billing: Sync subscriptions are billed on a yearly basis. Prices include applicable VAT.
- Cancellation: You can cancel your subscription at any time through your account settings. Your sync service will remain active until the end of your current billing cycle.
- EU Right of Withdrawal: If you are an EU consumer, you have the legal right to cancel your subscription within 14 days of purchase for a full refund. However, if you explicitly choose to start using the sync service immediately, you acknowledge that you lose this right of withdrawal once the service has been fully performed.
4. Privacy and Data
We respect your privacy and comply with the General Data Protection Regulation (GDPR). To provide the sync service, we need to process and store your data. We do not sell your data or use it for advertising. Please read our Privacy Policy to understand exactly what data we collect and your rights regarding it.
5. Acceptable Use
We ask that you respect our service and infrastructure. You agree not to:
- Use the Services for any illegal activities.
- Disseminate hateful or anti-democratic content on forums and chats with multiple participants.
- Engage in cyberstalking or bullying of other users.
- Repeatedly violate Netiquette and basic rules of politeness ("trolling").
- Interfere with or disrupt the security or performance of our servers.
- Attempt to reverse-engineer or extract the source code of our software (unless permitted by open-source licenses or applicable law).
Administrator Responsibilities for Encrypted Workspaces: Certain Services (like Daigo Projects) allow paying users to create and administer end-to-end encrypted communication spaces. If you act as an administrator, you are legally responsible for managing the space, the invited users, and the data shared within it. Because these spaces are encrypted, Daigosoft cannot read or moderate the content. You are obligated to use your administrative tools to moderate the space responsibly, ensure compliance with applicable laws, and enforce the above acceptable use rules among your participants.
6. Limitation of Liability
We work hard to ensure our Services are reliable, but software is never perfect.
- We provide the Services "as is" and without any absolute guarantees regarding uptime or data delivery, though we will act with professional diligence.
- We are fully liable for damages caused by our gross negligence or intentional misconduct.
- To the extent permitted by law, we are not liable for indirect damages, such as lost profits or severe data loss that could have been prevented by reasonable backups on your end. This does not affect your statutory rights as a consumer.
7. Changes to these Terms
We may update these Terms occasionally. If we make material changes, we will notify you by email or through the software at least 30 days before the changes take effect. If you do not agree with the new terms, you may cancel your subscription before they become active.
8. Governing Law and Disputes
These Terms are governed by the laws of Portugal. If a dispute arises, we would love to resolve it amicably first. Please contact us at support@daigosoft.com . If we cannot resolve it, the courts of Lisbon will have jurisdiction. If you are an EU consumer, you also have the right to bring proceedings in the courts of your home country, and you may use the EU Online Dispute Resolution platform at https://consumer-redress.ec.europa.eu/index_en.
